Acceptance of Terms

By accessing or using medcertsacademy.com (the "Site"), you agree to these Terms of Use and to the policies they incorporate by reference, including our Privacy Policy and Disclaimer. If you do not agree, please do not use the Site.

Educational Use Only

All content on the Site — flashcards, study guides, practice questions, quizzes, pharmacy calculations, law summaries, drug information, downloadable resources, Drug Quest, the Rx Library, and all other Study Center materials — is provided for general educational and exam-preparation purposes only, as described more fully in our Disclaimer. It is not medical, legal, or professional pharmacy practice advice and is not a substitute for official examination materials, current laws and standards, or professional judgment.

Intellectual Property

MedCert Academy's original materials — including its branding, logos, books, study guides, workbooks, flashcards, practice questions, original explanations, graphics, worksheets, the Drug Quest game and its artwork and assets owned or licensed by MedCert Academy, the Rx Library presentation, website design and content, downloadable educational resources, original compilations to the extent protectable, and marketing materials — are owned by or licensed to MedCert Academy and are protected by applicable intellectual-property laws.

You may use the Site's free materials for your own personal, non-commercial educational study. You may not, without our prior written permission: republish, resell, or redistribute our materials; mass-copy or systematically extract content; mirror the Site; upload our protected materials to other study platforms; create unauthorized commercial copies; remove copyright or trademark notices; or circumvent technical access restrictions.

MedCert Academy does not claim ownership of facts, drug names, government works, public-domain information, or third-party trademarks that appear in its materials.

Automated Access & Scraping

Unless expressly permitted by us in writing or required by applicable law, you may not use bots, crawlers, scrapers, or other automated systems to systematically copy or extract substantial portions of MedCert Academy's proprietary content, or to overload or interfere with the Site. This provision does not restrict the use of public-domain facts or information that MedCert Academy does not own.

Acceptable Use

You agree not to: interfere with the operation of the Site; attempt unauthorized access to any system or data; circumvent access controls; introduce malicious code; abuse our forms or email systems (including spam or automated submissions); impersonate MedCert Academy; redistribute protected materials unlawfully; or use the Site for any unlawful activity. We reserve the right to restrict or suspend access when reasonably necessary to protect the Site, its users, or MedCert Academy.

Your Responsibilities

You are responsible for determining whether our materials are suitable for your needs; verifying important information against current official sources; complying with applicable laws, regulations, employer policies, and examination rules; protecting your own devices and browser data; and maintaining any backups you need (study and game progress is stored only in your browser and can be lost if browser data is cleared).

Third-Party Links

The Site links to third-party services such as Amazon (book listings), TikTok and other social media, certification organizations, and government or reference resources. MedCert Academy does not control third-party websites and is not responsible for their content, availability, security, privacy practices, terms, products, or services. A link does not constitute endorsement unless expressly stated.

Free Services & Changes to the Site

MedCert Academy may modify features, correct content, update questions, change game content, add or remove resources, or suspend or discontinue features at any time. Resources that are currently free may be modified, restricted, replaced, or discontinued; we do not promise perpetual availability of any free service.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Site and all materials are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. We do not warrant uninterrupted availability, error-free operation, complete accuracy or currency of content, particular results (including examination results), or compatibility with every device or browser. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

Limitation of Liability

To the maximum extent permitted by applicable law, MedCert Academy and its owners, employees, and agents will not be liable for indirect, incidental, special, consequential, or exemplary damages arising out of or relating to your use of, or inability to use, the Site or its materials. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, and nothing limits any non-waivable consumer rights you may have under the laws of your place of residence.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless MedCert Academy from losses, damages, and reasonable costs arising from claims by third parties to the extent caused by your unlawful misuse of the Site, your violation of these Terms, or your infringement of third-party rights.

Governing Law

These Terms are governed by applicable law, including, where legally appropriate, the laws of the State of Washington, without regard to conflict-of-law principles. Nothing in these Terms is intended to override consumer-protection rights that apply to you under the laws of your place of residence.

Severability, No Waiver & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions continue in effect to the extent permitted by law. Our failure to enforce a provision on one occasion does not waive our right to enforce it later. These Terms, together with the policies they incorporate, constitute the entire agreement between you and MedCert Academy regarding your use of the Site; they do not modify any separately executed written agreement.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, provide reasonable notice. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms to the extent permitted by applicable law.

MedCert Academy™ and associated logos are trademarks of MedCert Academy. PTCB, PTCE, Amazon, TikTok, Google, EmailOctopus, and all other third-party names, marks, and certification marks referenced on the Site remain the property of their respective owners and are used for identification and reference only.
